1. Acceptance of Terms
By downloading, installing, or using ChessView ("the App"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the App.
These terms apply to all users, features, and functionality of ChessView, including but not limited to:
- Local chess game management and viewing
- Chess.com game import functionality
- AI-powered position analysis
- Game export and sharing features
2. Permitted Use
ChessView is designed for chess enthusiasts to analyze and review chess games. You may use the App for:
- Personal chess study and improvement
- Educational purposes and chess instruction
- Tournament preparation and game analysis
- Sharing chess knowledge with others
- Non-commercial chess-related activities
Fair Use: ChessView is free for personal, educational, and non-commercial use. Commercial use requires explicit permission.
3. Prohibited Activities
You agree NOT to:
- Use the App for any illegal or unauthorized purposes
- Attempt to reverse engineer, decompile, or modify the App
- Use the App to distribute malicious content or spam
- Violate any applicable laws or regulations
- Interfere with or disrupt the App's functionality
- Use the App in a way that could damage our reputation
- Circumvent any security measures or usage limitations
4. Chess.com Integration
When using our Chess.com integration feature:
- You are responsible for compliance with Chess.com's Terms of Service
- We only access publicly available game data through Chess.com's official API
- Chess.com retains all rights to their data and services
- This feature may be discontinued if Chess.com changes their API policies
Important: Ensure you have the right to access and download games from Chess.com before using this feature. We are not responsible for any violations of Chess.com's terms.
5. AI Analysis Service
Our AI analysis feature is powered by OpenAI's technology. When using this feature:
- You must provide your own OpenAI API key
- You are responsible for OpenAI API usage charges
- Analysis quality depends on OpenAI's service availability
- You agree to OpenAI's usage policies and terms
- We do not guarantee the accuracy of AI-generated analysis
API Responsibility: You are solely responsible for your OpenAI API key security and any charges incurred through its use.
6. Intellectual Property
6.1 ChessView App
ChessView is proprietary software owned by Pavel Gnatyuk. All rights, title, and interest in the App remain with the developer.
6.2 Chess Games and Content
Chess games themselves (moves, positions) are generally not subject to copyright. However:
- Game annotations and analysis may be protected by copyright
- You retain rights to your own game analyses and annotations
- Respect third-party content and attribution requirements
6.3 Third-Party Content
When importing games from Chess.com or other sources, respect the original source's terms and intellectual property rights.
7. User Content and Data
Regarding content you create or import in ChessView:
- You retain ownership of your chess games and analyses
- You are responsible for backing up your data
- We do not claim ownership of your content
- You grant us permission to process your data to provide App functionality
- Exported games may be shared according to your preferences
8. Disclaimers and Limitations
8.1 Service Availability
ChessView is provided "as-is" without warranties of any kind. We do not guarantee:
- Uninterrupted or error-free operation
- Compatibility with all devices or iOS versions
- Accuracy of imported game data
- Availability of third-party integrations
8.2 AI Analysis Disclaimer
AI-generated chess analysis is provided for educational purposes only. We make no claims about the accuracy, completeness, or quality of AI analysis results.
No Chess Advice: ChessView is not a substitute for professional chess instruction. Use AI analysis as a learning tool, not as definitive chess advice.
9. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid for the App (if any)
- We are not responsible for third-party service failures or charges
- You use the App at your own risk
This limitation applies even if we have been advised of the possibility of such damages.
10. App Store Terms
If you downloaded ChessView from the Apple App Store, you also agree to Apple's Terms of Service. In case of conflicts between these terms and Apple's terms, Apple's terms take precedence for App Store-related matters.
11. Updates and Modifications
We may update these Terms & Conditions from time to time. When we do:
- We will update the "Last Updated" date
- Significant changes will be communicated through app updates
- Continued use of the App constitutes acceptance of updated terms
- If you disagree with changes, discontinue use of the App
12. Governing Law and Disputes
These terms are governed by the laws of your jurisdiction. For disputes:
- First, contact us directly to resolve issues amicably
- We prefer informal resolution over formal legal proceedings
- Most issues can be resolved through open communication
13. Termination
These terms remain in effect until:
- You delete the App from your device
- We discontinue the App (with reasonable notice)
- You violate these terms (automatic termination)
Upon termination, you must stop using the App and may delete any related data.
